Supershirt Terms of Service & Conditions of Sale

These Terms of Service and Conditions of Sale (“Terms”) govern your use of Supershirt’s website, products, custom decoration services, online design tools, quotes and orders.

“Supershirt,” “we,” “us,” and “our” refer to Supershirt, located at 875 Foster Ave., Unit 118, Windsor, Ontario N8X 4W3, Canada.

By placing an order, approving a quote or artwork proof, submitting payment, creating an account, uploading artwork, or otherwise using our services, you agree to these Terms.

Nothing in these Terms limits any right or remedy available to a consumer that cannot lawfully be waived under applicable law.

1. Products and Custom Services

Supershirt provides custom apparel, promotional products and decoration services including screen printing, direct-to-film (“DTF”) printing, embroidery, laser engraving, patches and related customization services.

Most decorated products are produced specifically according to the customer’s selections, quantities, artwork and instructions.

Product photographs, mockups and digital previews are provided as visual references. Actual products may vary slightly because of manufacturing, monitor/display differences, garment dye lots, materials, decoration processes and other normal production variables.

2. Quotes and Pricing

Quotes are based on the products, quantities, sizes, colours, decoration methods, print locations, artwork and other specifications provided at the time of quotation.

Unless otherwise stated on the quote, a quote is valid until the expiration date shown on it.

A change to quantity, product, colour, size breakdown, artwork, decoration method, print location or other specification may result in a revised price.

Prices displayed online or in a quote may be corrected if an obvious typographical, technical, calculation or system error occurs. If an error materially affects an order already placed, we will contact the customer before proceeding.

Applicable taxes, shipping and other charges are shown during checkout or on the applicable quote or invoice where required.

3. Payment

Custom orders generally require payment in full before production begins unless Supershirt has approved other payment arrangements in writing.

Submitting payment does not constitute artwork approval unless the applicable artwork has also been approved or no proof is required.

Supershirt may suspend production or shipment when payment is incomplete, declined, disputed or otherwise outstanding.

4. Order Acceptance

An order is subject to acceptance by Supershirt.

We reserve the right to refuse or cancel an order before production for legitimate reasons including product unavailability, pricing or technical errors, suspected fraud, unlawful or prohibited artwork, intellectual-property concerns or inability to complete the requested customization.

If we cancel an order that has been paid and production has not been performed, amounts paid for the cancelled portion will be refunded as appropriate.

5. Artwork and Proof Approval

Customers are responsible for carefully reviewing all artwork and proofs before approval.

  • Spelling and grammar
  • Names and numbers
  • Colours
  • Artwork placement
  • Dimensions and proportions
  • Orientation
  • Logos
  • Quantities
  • Garment/product selections
  • Other design details

Once artwork is approved, Supershirt is entitled to rely upon that approval and production may begin.

Approval by email, through our website, through an electronic quote or approval system, or by another written electronic communication constitutes approval.

Supershirt is not responsible for an error contained in artwork or a proof that the customer approved.

If a customer requests a correction or reprint because of an error contained in an approved proof, additional product, setup, decoration, shipping and other applicable charges may apply.

6. Customer Artwork, Logos and Intellectual Property

Customers retain whatever ownership rights they lawfully hold in artwork they provide to Supershirt.

By uploading, emailing or otherwise providing artwork, photographs, logos, trademarks, names, designs or other content (“Customer Content”), the customer represents that they own the content or have all permissions, licences and authority necessary for Supershirt to reproduce and use it for the requested order.

The customer grants Supershirt a limited licence to reproduce, modify as reasonably necessary for production, process and use Customer Content for purposes of preparing proofs and producing and fulfilling the customer’s order.

Supershirt is not responsible for independently determining ownership of customer-supplied intellectual property.

We may request evidence of authorization and may refuse to reproduce material where we reasonably believe the requested use may violate intellectual-property rights or applicable law.

To the extent permitted by law, the customer agrees to indemnify and hold Supershirt harmless from third-party claims, damages, liabilities and reasonable legal costs arising from Customer Content supplied or authorized by the customer that infringes another party’s copyright, trademark or other proprietary rights.

7. Online Designer, Uploaded Files and AI Tools

Supershirt may provide online design, image editing, background removal, artificial intelligence and other automated tools.

These tools are provided to assist customers in creating or preparing designs. Automated results may contain errors or unexpected changes.

The customer is responsible for reviewing the final design and proof before approving an order.

AI-generated or AI-modified content is not guaranteed to be unique or to qualify for copyright, trademark or other intellectual-property protection.

Supershirt does not represent that AI-generated or customer-created content is free of third-party intellectual-property rights.

The customer remains responsible for ensuring that the final content they instruct Supershirt to reproduce may lawfully be used.

8. Artwork Quality

The quality of the finished decoration depends partly on the quality of the artwork provided.

Low-resolution images may produce lower-quality results.

Supershirt may make reasonable adjustments necessary to prepare artwork for production, but we are not responsible for defects inherent in customer-supplied files.

Additional artwork or design charges may apply when substantial artwork reconstruction, vectorization, cleanup or modification is required.

9. Colour Matching

Colours displayed on computer monitors, phones, tablets and printed paper may differ from actual ink, thread, transfer, engraving, patch or garment colours.

Exact colour matching is not guaranteed unless Supershirt expressly agrees to a specific colour-matching requirement in writing.

Reasonable variations in colour are not considered defects.

Colours may also vary between production runs because of garment dye lots, ink, thread, substrate and manufacturing variations.

10. Print and Decoration Placement

Custom decoration involves manual and mechanical production processes.

Minor variations in positioning, alignment, dimensions and appearance may occur between individual pieces.

Reasonable production variations are not considered defects.

Placement may also vary because of garment construction, seams, pockets, zippers, hoods, panels and differences between garment sizes.

11. Garment and Product Variations

Products are manufactured by third-party manufacturers.

Supershirt does not manufacture most blank garments or promotional products.

Manufacturers may make changes to sizing, fabric, colour, construction, labelling, packaging or other specifications without notice.

Sizing may also vary between brands, styles and manufacturing batches.

Customers are responsible for reviewing the applicable size information before ordering.

12. Supplier Inventory and Availability

Product availability displayed on the website may be based on information received from Supershirt’s suppliers.

Although we make reasonable efforts to keep availability current, supplier inventory can change rapidly and is not guaranteed until an order is confirmed and the required merchandise is secured.

If an ordered product, size or colour becomes unavailable, Supershirt may contact the customer to discuss alternatives, substitutions, delays or an appropriate refund for the unavailable portion.

We will not make a materially different substitution without customer authorization.

13. Production Times

Production times are estimates and begin only after all requirements necessary for production have been satisfied, which may include payment, artwork approval, product availability, final quantities and sizes, receipt of customer-supplied goods, and any other information required to complete the order.

Our standard turnaround is generally approximately two weeks unless otherwise stated.

Production estimates are not guaranteed delivery dates.

Rush service may be available by prior arrangement and may involve additional charges.

14. Shipping and Delivery

Shipping and delivery dates are estimates.

Once an order has been transferred to a carrier, circumstances outside Supershirt’s reasonable control may affect delivery.

Supershirt is not responsible for carrier delays caused by weather, transportation disruptions, incorrect addresses, recipient unavailability or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

If an order is returned because of an incorrect, incomplete or undeliverable address supplied by the customer, additional shipping charges may be required before reshipment.

15. Free Shipping Promotions

Any free-shipping offer is subject to the conditions displayed with the offer.

Where Supershirt offers free shipping above a specified order value, eligibility is generally calculated using the merchandise/order subtotal before taxes and after applicable discounts unless otherwise stated.

Additional charges may apply to unusually large, heavy, remote or special-delivery shipments where clearly disclosed before the order is finalized.

16. Cancellations and Changes

Because custom products are made specifically for each customer and production may begin shortly after approval and payment, orders generally cannot be cancelled or changed once production has begun.

If you need to cancel or modify an order, contact Supershirt immediately.

If production has not begun and products have not been specially ordered or committed, we may be able to accommodate the request.

If costs have already been incurred for artwork, setup, merchandise, screens, digitizing, production or other work, those amounts may be non-refundable to the extent permitted by applicable law.

Nothing in this section limits cancellation or refund rights that a consumer has under applicable law.

17. Custom Products — Returns and Exchanges

Because decorated and personalized merchandise is manufactured specifically for the customer, custom products generally cannot be returned or exchanged because of:

  • Incorrect size selection
  • Change of mind
  • Colour preference
  • Customer-approved artwork
  • Customer ordering errors
  • Other reasons unrelated to a defect or error by Supershirt

Please review product specifications, sizing, quantities and artwork carefully before approving an order.

Nothing in this policy excludes rights that cannot lawfully be excluded under applicable consumer-protection legislation.

18. Defective, Damaged or Incorrect Orders

Customers should inspect their order promptly after delivery.

Claims concerning printing errors, manufacturing problems, shortages, damage or incorrect products should be reported to orders@supershirt.ca within five (5) days of receipt, where reasonably possible.

Please include the order number, a description of the issue and photographs when applicable.

If Supershirt determines that an order contains a material error caused by us, we will provide an appropriate remedy, which may include repair, replacement, reprinting, credit or refund depending upon the circumstances and applicable law.

Customers should not discard allegedly defective products until the claim has been resolved.

19. Customer-Supplied Garments and Products

Supershirt may, at its discretion, agree to decorate merchandise supplied by a customer.

Decoration processes involve inherent risks, including equipment malfunction, heat damage, staining, scorching, misprints, embroidery damage and other production errors.

Customer-supplied merchandise is therefore accepted at the customer’s risk.

To the fullest extent permitted by law, Supershirt’s liability for damage to customer-supplied merchandise will not exceed the reasonable replacement value of the affected item, subject to any specific written agreement made before production.

For rare, irreplaceable, sentimental or unusually valuable items, customers should discuss the item with Supershirt before submitting it for decoration.

20. Screens, Digitizing and Production Files

Unless otherwise agreed in writing, production materials and production-ready files created by Supershirt—including screen separations, screens, embroidery digitizing files, machine files and internal production files—remain the property of Supershirt.

Payment for setup, screen or digitizing charges compensates Supershirt for preparing production and does not automatically transfer ownership of Supershirt’s production files or physical production materials.

Customer ownership of their original artwork is unaffected.

21. Overruns and Underruns

Where manufacturing or bulk-production processes make exact quantities impractical, reasonable overruns or underruns may occur only where disclosed or customary for the applicable product or service.

For orders where Supershirt has expressly agreed to provide an exact quantity, we will use reasonable efforts to provide that quantity.

22. Prohibited Content

Supershirt may refuse to produce content that we reasonably believe:

  • Violates applicable law
  • Infringes intellectual-property rights
  • Constitutes unlawful threats or harassment
  • Promotes unlawful activity
  • Otherwise exposes Supershirt to unreasonable legal risk

A refusal to reproduce particular content does not constitute a determination regarding the legality of that content.

23. Website Information

We make reasonable efforts to maintain accurate product descriptions, images, prices, inventory and specifications.

However, errors may occasionally occur.

Supershirt may correct errors and update website information.

If a material error affects an order that has already been submitted, we will contact the customer before materially changing or proceeding with the affected portion of the order.

24. Third-Party Services

Our website and services may interact with third-party providers including payment processors, shipping carriers, suppliers, design resources and other services.

Supershirt is not responsible for the independent operation, policies or availability of third-party services except to the extent responsibility cannot lawfully be excluded.

25. Warranty Disclaimer

Except for warranties or conditions that cannot lawfully be excluded, products and services are provided subject to the specifications agreed for the applicable order.

Supershirt does not make additional warranties regarding fitness for a particular purpose where the customer has independently selected the product and specifications without relying on a specific written recommendation from Supershirt.

Nothing in these Terms excludes any warranty, condition or statutory protection that cannot legally be excluded.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Supershirt will not be liable for indirect, incidental, special or consequential damages, including loss of profits, business opportunities or anticipated savings arising from an order or use of our services.

To the fullest extent permitted by law, Supershirt’s aggregate liability arising from a particular order will not exceed the amount paid to Supershirt for the portion of that order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited.

27. Force Majeure and Events Beyond Our Control

Supershirt will not be responsible for delays or failure to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, fire, flood, power or internet outages, labour disruptions, transportation interruptions, carrier delays, supplier shortages, government actions, public emergencies, equipment failures that could not reasonably have been prevented, or similar events.

We will make reasonable efforts to communicate significant delays and resume performance when reasonably possible.

28. Electronic Communications and Marketing

Customers agree that order confirmations, quotes, proofs, invoices, shipping notifications and other communications relating to an order may be provided electronically.

Transactional communications necessary to administer an order are separate from promotional marketing communications.

Marketing emails or electronic messages will be sent in accordance with applicable Canadian law.

29. Privacy

Personal information is handled in accordance with Supershirt’s Privacy Policy and applicable privacy laws.

Payment information may be processed by third-party payment providers according to their applicable terms and privacy policies.

30. Governing Law

These Terms and any dispute arising from them are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any rights a consumer may have under applicable law, disputes shall be brought before courts of competent jurisdiction in Ontario.

31. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

32. No Waiver

Failure by Supershirt to enforce a provision of these Terms on one occasion does not waive our right to enforce it later.

33. Changes to These Terms

Supershirt may update these Terms from time to time.

The version applicable to an order will generally be the version in effect when the applicable agreement or order is entered into, except where a change is required by law or otherwise agreed with the customer.

The “Last Updated” date at the top identifies the current version.

34. Entire Agreement

These Terms, together with the applicable quote, order, approved proof, invoice, checkout information, Privacy Policy, Return Policy and any written terms specifically agreed between Supershirt and the customer, form the agreement applicable to the transaction.

If a specific written quote or agreement expressly conflicts with these general Terms, the specifically agreed written provision will govern that particular order to the extent of the conflict.
